Terms of Service

1. About these terms

These Terms of Service ("Terms") are a binding agreement between you and KULT AI LIMITED ("Kult", "we", "us"), a company registered in England and Wales (company number 16973445).

They govern your use of the Kult website, apps, and voice assistant (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.


2. Eligibility and age

You must be at least 18 years old to use the Service. The Service is for adults and is not intended for anyone under 18.

By using the Service you confirm that you are 18 or over, that you can form a binding contract with us, and that you are not barred from doing so under any applicable law.


3. Your account

  • You're responsible for keeping your login details secure and for everything that happens under your account.
  • Provide accurate information and keep it up to date.
  • Tell us promptly at support@joinkult.ai if you suspect unauthorised use.
  • One person per account; don't share or transfer your account without our consent.

4. What Kult is — and the alpha disclaimer

Kult is an AI voice companion for video games. It answers questions about games using a knowledge base built from public sources, combined with live web search, and delivered through a voice assistant.

The Service is in early-access / alpha. It is experimental. It may contain errors or defects, may be unavailable, may change, and may be discontinued at any time without notice. Features may be added, changed, or removed at our discretion. We provide it without any service-level commitment or guarantee of availability. We may also set usage limits.


5. AI output — accuracy and reliance

Please understand how the assistant works before relying on it:

  • AI output can be wrong. The assistant uses AI models that are probabilistic by nature. They may produce answers that are inaccurate, incomplete, out of date, or inappropriate, even when they sound confident ("hallucinations").
  • Games change. Game information changes frequently with patches, updates, and balance changes. Our answers may be out of date or no longer correct for the version you're playing.
  • Don't rely on it as your only source. You should independently verify anything that matters to you. Do not rely on the assistant's output as a sole source of truth, or for any decision where accuracy is important.
  • Not professional advice. The Service is for gaming information and entertainment. It is not professional, legal, medical, financial, or other expert advice.

You are responsible for evaluating the output before you act on it. Nothing in this section limits the rights you have as a consumer (see §14).


6. Acceptable use

You agree not to:

  • use the Service for anything unlawful, harmful, fraudulent, or abusive;
  • harass, threaten, or harm others, or generate or share illegal or infringing content;
  • attempt to access accounts, data, or systems you're not authorised to access, or probe or breach our security;
  • scrape, crawl, harvest, or extract data from the Service by automated means, or copy or resell our knowledge base, content, or answers;
  • reverse engineer, decompile, or disassemble any part of the Service, or try to derive its source code or underlying models, except where the law expressly permits;
  • circumvent any access restriction, rate limit, or block we apply (for example by masking your IP or using proxies);
  • introduce malware, or place an unreasonable or disproportionate load on our infrastructure;
  • use the Service to build or train a competing product or model;
  • misrepresent your affiliation with us or any game publisher.

We may investigate and take action — including suspending or terminating your access — for any breach.


7. Fair play and game rules

Kult provides information and guidance only. It does not interact with, inject into, modify, automate, or read memory from any game, and is designed not to provide an unfair competitive advantage or to break any game's rules or terms.

You are responsible for making sure your use of Kult complies with the terms of service, rules, and fair-play / anti-cheat policies of any game you play. We are not responsible for any action a game publisher takes against your game account. Do not use Kult in any way that would breach a game's rules, and do not use it to cheat or to gain a prohibited advantage in competitive or ranked play.


8. Your content and voice input

"Your Content" means the questions you ask, audio you speak, and other input you provide to the Service.

  • You keep ownership of Your Content.
  • You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content for the purpose of operating, providing, securing, and improving the Service, including sending it to the AI providers needed to generate responses (see our Privacy Policy).
  • This licence includes your voice audio and transcripts, and is subject to our Privacy Policy and any choices you make there (for example, opting out of use of your content to improve the Service).
  • You're responsible for Your Content and confirm you have the rights to provide it and that it doesn't break these Terms or any law.

9. Game names, third-party content, and non-affiliation

Kult discusses many games and draws on publicly available information.

  • We are not affiliated with any game publisher. Kult is not endorsed by, affiliated with, maintained, authorised, or sponsored by any game developer or publisher.
  • Trademarks belong to their owners. All game titles, characters, names, logos, and related marks are the trademarks or registered trademarks of their respective owners. We refer to them only descriptively, to identify the games the Service discusses.
  • Third-party information. Information in the Service may be drawn from or reference third-party sources (such as community wikis, forums, and videos). Those sources and their rights belong to their owners, and we make no warranty as to their accuracy or completeness.

If you are a rights holder and believe content in the Service infringes your rights, contact us at legal@joinkult.ai and we will respond.


10. Our intellectual property

The Service — including our software, design, branding, "Kult" name and logos, and the compiled knowledge base and answers we generate — is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms. We reserve all other rights.

You may submit feedback or suggestions; if you do, you grant us the right to use them without restriction or obligation to you.


11. Paid features and payment

The Service is currently free during alpha. If we introduce paid features or subscriptions, additional terms (pricing, billing, renewal, and your statutory cancellation rights) will apply and will be presented to you before you pay.


12. Termination

  • You can stop using the Service and close your account at any time.
  • We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably believe your use poses a risk to the Service or others, or if we stop offering the Service.
  • Sections that by their nature should survive termination (including §§5, 8–10, 13–16) will survive.

13. Disclaimer of warranties

To the fullest extent permitted by law, and subject to §14, the Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that its output will be accurate or reliable.


14. Your rights as a consumer

Nothing in these Terms excludes or limits rights you have under mandatory consumer law that cannot be excluded. If you are a consumer in the UK, you have legal rights under the Consumer Rights Act 2015, including that services are performed with reasonable care and skill and that digital content is of satisfactory quality. If you are a consumer in the EEA, you keep the mandatory protections of the country where you live. These statutory rights are not affected by anything in these Terms.


15. Limitation of liability

Nothing in these Terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited or excluded under applicable law (including your mandatory consumer rights under §14).

Subject to that, and to the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or game progress or accounts, arising out of or relating to your use of the Service.
  • We are not liable for any loss arising from your reliance on the assistant's output, or from any action taken against your game account by a game publisher.
  • Our total liability to you for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) £100.

16. Indemnity

If you use the Service in breach of these Terms or the law, you agree to indemnify and hold us, our officers, employees, and agents harmless from any claims, liabilities, damages, losses, and reasonable costs (including legal fees) arising from that breach, to the extent permitted by law.


17. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute — except that, if you are a consumer, this does not deprive you of the mandatory protections or the right to bring proceedings in the country where you live. We'll always try to resolve issues with you directly first — contact support@joinkult.ai.


18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll give you reasonable notice (e.g. by email or in-app) before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you don't agree, stop using the Service and close your account.


19. General

  • Severability — if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver — if we don't enforce a right, that's not a waiver of it.
  • Assignment — you may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Entire agreement — these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
